These Terms of Use (“Terms”) apply to your use of the Lambing Season Pro mobile application (“Lambing Season Pro” or “the App”). Lambing Season Pro is a registered business name of Taylor Mitchell & Co. Wool Pet Products, Ltd. By downloading, purchasing, or using Lambing Season Pro, you agree to these Terms.
Purpose of the App
Lambing Season Pro is a farm-management and record-keeping tool designed to assist users with organizing and managing sheep breeding and lambing information. The App is intended to assist with record keeping and farm management. It is not a substitute for professional veterinary, agricultural, financial, or other professional advice.
User Responsibility
You are responsible for the information you enter into the App and for verifying the accuracy and completeness of your records. Farm and animal-management decisions remain the responsibility of the user. Lambing Season Pro is not responsible for losses resulting from inaccurate information entered into the App, incorrect interpretation of information displayed by the App, or reliance on the App in place of appropriate professional advice.
Data and Backups
Information entered into Lambing Season Pro is stored locally on your device.
You are responsible for maintaining appropriate backups of your data and device.
We cannot guarantee recovery of information that is lost because of device loss, damage, replacement, software failure, deletion, or other circumstances outside our control.
Purchases
Purchases of Lambing Season Pro and any optional paid upgrades are processed through Apple's App Store. Payment, billing, refunds, and other App Store transaction matters are subject to Apple's applicable terms and policies. Lambing Season Pro does not require a recurring subscription. Any optional upgrade offered within the App is a one-time purchase unless otherwise clearly stated before purchase.
License to Use the App
Your purchase or download of Lambing Season Pro provides you with a personal, limited, non-exclusive, non-transferable license to use the App in accordance with these Terms and Apple's applicable App Store terms. You may not copy, redistribute, sell, reverse engineer, modify, or commercially exploit the App except where such restriction is prohibited by applicable law.
Intellectual Property
Lambing Season Pro, including its software, design, graphics, branding, text, and other original content, is owned by or licensed to Taylor Mitchell & Co. Wool Pet Products, Ltd. and is protected by applicable intellectual-property laws. “Lambing Season Pro” and associated branding may not be used in a manner that suggests endorsement, affiliation, or authorization without our permission.
Availability and Updates
We may update, modify, improve, or discontinue features of Lambing Season Pro from time to time. We do not guarantee that the App will always be available without interruption or that it will be compatible with every device or future operating-system version.
Disclaimer
To the extent permitted by applicable law, Lambing Season Pro is provided on an “as available” basis without warranties beyond those that cannot legally be excluded. Nothing in these Terms excludes or limits rights or remedies that cannot be excluded or limited under applicable consumer law.
Limitation of Liability
To the extent permitted by applicable law, Taylor Mitchell & Co. Wool Pet Products, Ltd. will not be liable for indirect, incidental, special, or consequential losses arising from the use of, or inability to use, Lambing Season Pro. Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
Changes to These Terms
We may update these Terms to reflect changes to Lambing Season Pro, applicable law, or our business practices. The current version will be made available on the Lambing Season Pro website with its effective date.
Governing Law
These Terms are governed by the laws of Ireland, subject to any mandatory consumer-protection rights that may apply based on the user's place of residence.
